Ford India asked to pay Rs 75,000 for faulty car

Auto giant Ford India has been asked by the Delhi State Consumer Commission (DSCC) to pay a compensation of Rs 75,000 to a customer for selling him a defective car.

The DSCC bench ordered the company to compensate its customer saying it was manufacturer's duty to provide a defect-free vehicle to the buyer, while the company and its dealer have not produced evidence to show that the defects occurred due to the rash and negligent driving by the owner.

"It is the duty of the dealer/manufacturer under the law to provide a defect free vehicle to the purchaser. It becomes clear from the facts that the vehicle was suffering from various defects which were most likely manufacturing defects," a bench of commission comprising its President Justice Barkat Ali Zaidi and Member Salma Noor said.

The bench gave its order, upholding the verdict of a district consumer forum here which had awarded a compensation of Rs 75,000 to complainant N Ranganathan, a resident of Dilshad Garden in East Delhi, for harassment caused to him due the defective car.


"The district forum was wholly justified in holding Ford India Pvt Ltd deficient in service and to pass an award of compensation along with costs in favour of the complainant and the findings of the district forum, cannot be faulted in any way. The order of the district forum is fully justified," it said.
